How foreclosure works in New York

New York requires lenders to go through the courts. That makes the process slower than in many states, and it gives homeowners real chances to act. In general, a lender must send a 90-day pre-foreclosure notice under RPAPL §1304 before filing. The case is then filed in the State Supreme Court for your county (for example, in White Plains for Westchester, Goshen for Orange, Poughkeepsie for Dutchess or Kingston for Ulster). For owner-occupied homes, the court schedules a mandatory settlement conference under CPLR 3408, where you or your attorney can discuss a loan modification, forbearance, short sale or other options with the lender.

If no resolution is reached, the court may grant a judgment of foreclosure and sale, and a referee holds an auction, usually at or near the county courthouse. Until that sale, you generally still own the home.

Where selling fits in

If you have equity, selling before the auction can pay off the loan, arrears and fees at closing and put the rest in your pocket, instead of losing it at a forced sale. Even with little equity, a sale may help you avoid a deficiency or a foreclosure on your record; that is a question for your attorney. The earlier you reach out, the more options you have, because a cash sale still needs time for title work, a payoff letter and attorney review.

Get free help, too

Before you decide anything, we recommend talking to a free housing counselor or legal services attorney through the New York State Homeowner Protection Program (HOPP). Be cautious of anyone who asks for upfront fees to "save" your house; New York's distressed property consultant law (RPL §265-b) protects homeowners from those schemes. We never charge you a fee, and you are never obligated to accept our offer.

What we need from you

The property address, roughly what you owe, and any dates you have received (a settlement conference date, a judgment, or a sale date). With that, we can tell you quickly whether a cash sale could work on your timeline.

Where we buy

We buy in Westchester, Rockland, Orange, Putnam, Dutchess, Ulster, Sullivan, Greene, Columbia counties. See all areas.

Frequently asked questions

Can I sell my house if a foreclosure case has been filed?

Usually yes, until the foreclosure sale. The loan is paid off from the sale proceeds at closing. Your attorney can confirm for your case.

How long does foreclosure take in New York?

It varies widely by county and case, often well over a year because it is a court process. Do not count on delays though; act early.

Will you charge me anything?

No. We don't charge fees. Be wary of anyone who asks for upfront payment to stop a foreclosure.

What if I owe more than the house is worth?

A cash sale may not work without lender approval of a short sale. Talk to us and to a housing counselor; we will be honest if we can't help.
